Terms & Conditions

These Terms & Conditions (“Terms”) govern your use of the Plantoni mobile application (the “App”) provided by Plantoni (the “Service Provider”). The App is offered as a freemium service.

Agreement to these Terms

By downloading, installing, or using the App, you agree to these Terms. If you do not agree, do not use the App. You are responsible for compliance with these Terms and with applicable laws.

Privacy

Our collection and use of personal information is described in the Privacy Policy. By using the App, you also acknowledge that policy.

License and intellectual property

The Service Provider grants you a limited, non-exclusive, non-transferable, revocable license to use the App for your personal, non-commercial use in line with these Terms and with Apple’s applicable App Store rules.

You may not copy, modify, distribute, sell, lease, or reverse engineer the App, attempt to extract its source code, create derivative works, or misuse the Service Provider’s names, logos, or branding. All rights in the App not expressly granted are reserved.

Changes to the App, features, and pricing

The Service Provider may update, modify, or discontinue features of the App at any time. Paid features or subscriptions may be introduced or changed; where charges apply, they will be presented through the App Store (and, where applicable, our subscription partner) before you confirm a purchase.

Subscriptions and payments

In-app purchases and subscriptions are processed by Apple and may involve our subscription partner. Payment terms, renewals, and cancellations follow Apple’s terms and the purchase flow shown in the App. The Service Provider does not store your full payment card number.

Your device and data

Much of your content may be stored on your device and, if you use optional sync, via Apple iCloud, as described in the Privacy Policy. You are responsible for maintaining the security of your device and for any activity under your Apple ID.

The Service Provider recommends that you do not jailbreak or root your device; doing so can weaken security, expose you to malware, and cause the App to malfunction.

Third-party services

The App relies on third-party services that have their own terms and privacy policies, including for analytics, crash reporting, subscriptions, push notifications, advertising measurement, cloud infrastructure, and artificial intelligence processing. Examples include (as applicable):

Your use of those services is subject to their terms. Apple’s terms also apply to your use of the App from the App Store (see Apple Media Services Terms where applicable).

Advertising and tracking

The App may show or measure advertising for Plantoni on third-party platforms (such as Meta’s family of apps). With your permission given through Apple’s App Tracking Transparency prompt, the App may share your device’s advertising identifier and app event data with these partners for attribution and measurement, as described in the Privacy Policy. You can withdraw this permission at any time in iOS Settings.

Internet connectivity and charges

Some features require an internet connection. The Service Provider is not responsible for outages, slow connections, or lack of Wi-Fi or mobile data.

If you use the App on a mobile network, your carrier’s rates and terms apply, including possible data or roaming charges. You are responsible for those charges.

Keeping your device charged and in working order is your responsibility; the Service Provider is not liable for inability to access the App due to a dead battery or device failure.

AI, plant information, and no professional advice

The App may use artificial intelligence and other automated tools to identify plants, suggest care information, or respond in chat. Results may be incomplete, incorrect, or unsuitable for your situation. Plant identification, care, and “diagnosis” features are for general information only and are not professional agronomic, veterinary, medical, or safety advice.

Do not rely solely on the App to determine whether a plant or substance is safe for people or pets. Always verify critical facts (especially toxicity and allergies) with qualified experts and local resources. You use AI and identification features at your own risk.

Disclaimer of warranties

To the maximum extent permitted by law, the App is provided “as is” and “as available” without warranties of any kind, whether express or implied, including implied warranties of merchantability, fitness for a particular purpose, or non-infringement.

Limitation of liability

To the maximum extent permitted by applicable law, the Service Provider and its suppliers shall not be liable for any indirect, incidental, special, consequential, or punitive damages, or for loss of profits, data, or goodwill, arising from your use of the App or reliance on any content or AI output.

Where liability cannot be excluded, the Service Provider’s total liability for any claim arising out of these Terms or the App shall be limited to the greater of (a) the amount you paid to the Service Provider for the App in the twelve (12) months before the claim, or (b) if no such payment was made, fifty euros (€50) or the equivalent in your local currency, except where mandatory law requires otherwise.

Updates and termination

The Service Provider may require you to install updates to continue using the App. The App may not remain compatible with every device or operating system version.

The Service Provider may suspend or stop offering the App or may terminate your right to use it. Upon termination, your license ends and you must stop using the App and delete it from your devices if required.

Changes to these Terms

The Service Provider may update these Terms by posting a new version at this URL. Material changes may also be communicated through the App or other reasonable means where appropriate. Continued use after the effective date of changes constitutes acceptance, except where your local law requires different consent.

If you are a consumer in the European Economic Area, Switzerland, or the United Kingdom, you retain any mandatory rights under the laws of your country of residence.
